Can a juvenile record be sealed or expunged?

Many people in Florida have the mistaken belief that juvenile records automatically go away once the youth reaches the age of 18. This is not the case, however. When a person has a juvenile criminal record, he or she must apply to have the record either sealed or expunged after they have successfully completed all terms of their adjudication.

Low-risk Florida juveniles do better with less supervision

Although people may have the idea that providing intensive levels of supervision to juveniles will help stave off recidivism rates, that is not always the case. Studies on Florida juveniles who are assessed at a low risk to re-offend actually demonstrate the opposite for that population of juvenile offenders, even if they are also determined as having high needs.

Pain clinic operators sentenced to 30 years in prison

A Florida judge ordered three people to serve at least 25 years out of 30-year prison sentences for operating a pain clinic in Tampa that dispensed controlled dangerous substances. According to the judge, the 4.5-month trial that was completed in March was the longest criminal trial that had ever taken place in Hillsborough County Circuit Court. Before they were handed the drug charges, the accused individuals had apparently been the subjects of an investigation since 2009.

Florida city cannot seek forfeiture of drug residence

A Florida appeals court ruled on Sept. 12 that the city of Maitland would not be allowed to seize a residence where marijuana was reportedly grown. The court reasoned that the forfeiture would constitute an excessive penalty. The owner of the home was charged with manufacturing and selling drugs.
