Three arrested on drug charges in Boca Raton

An arrest for sale or possession of illegal drugs can have serious consequences in Florida. In addition to possible fines and jail time if convicted, a drug conviction on a person's record can create problems with future employment and housing. Three men arrested on drug charges in Boca Raton recently are dealing with these possibilities now.

The three men, two 19 and one 18 years old, were arrested by Boca Raton police near a gas station that has been the scene of numerous drug arrests in the past. One of the 19-year-olds was charged with the sale of cocaine 1000 feet or less from of a place of business or worship, sale of marijuana, possession of drug paraphernalia and resisting a police officer. The second 19-year-old was charged with marijuana possession and resisting a police officer. The third man, the 18-year-old, also faces marijuana possession and resisting police charges.

Of the three men charged, the man charged with selling cocaine faces the most serious charges. As in any criminal prosecution, the state has the burden of proving every element of its case beyond a reasonable doubt - including the element of intent.

News reports do not indicate whether the man was arrested after a sale to an undercover officer. If that was the case, entrapment may be a defense. Entrapment occurs when police tempt a citizen into committing a crime they were not predisposed to commit. If successful, an entrapment defense can result in dismissal of the charges.

If the evidence against the men is very strong, defense counsel can still work to negotiate plea agreements in the three cases. In the case of the man charged with selling, it may be possible to negotiate the charges down to simple possession - a much less serious charge.
