Heroin incident results in detention of 2 men

Florida residents may be surprised at the location of an alleged drug incident in California. Two men, ages 28 and 27, were charged after officials received a report of their presence in a Chuck E. Cheese bathroom stall. A customer at the establishment contacted officers, indicating that the men were using drugs in the location. The 28-year-old man has been charged with possession of drug paraphernalia and a controlled substance. While the paraphernalia is a misdemeanor charge, the controlled substance issue is considered a felony charge. Both men are charged with being under the influence of a controlled drug, a misdemeanor.

Officials indicated that they found a small quantity of heroin as well as drug paraphernalia. They also note that the men were at the pizza restaurant to meet a supplier. Additional drug activity on the premises has not been reported. However, a spokesperson for Chuck E. Cheese indicates concern about the situation, recognizing that the alleged behavior of these adults in an establishment that caters to children is disturbing.

The 28-year-old man was released after posting $20,000 bail, and the other man was released after acknowledging in writing that he would show up for a court date. Reports do not indicate whether chemical testing was used to verify the alleged drug use. While possession and signs of intoxication may give the appearance of being under the influence, test results may provide additional information about the incident. A lawyer representing either of these men may evaluate these tests to determine the best manner of defending a client.

If toxicology reports do not corroborate the charges of being under the influence of a controlled substance, a lawyer may move to have those charges dismissed. If the tests support the charges, a lawyer may recommend seeking a plea deal for reduced charges and penalties.
